NCplay respects the intellectual property rights of artists, labels, and content creators. This policy outlines how we handle copyright infringement claims in accordance with the Digital Millennium Copyright Act (DMCA) and applicable international copyright laws.

All music, artwork, and media available on NCplay is uploaded and managed exclusively by our administrative team. NCplay does not allow users to upload music or other copyrighted content. We take reasonable steps to ensure that all content on our platform is properly licensed or authorized for distribution.
2. Reporting Copyright Infringement
If you believe that content available on NCplay infringes your copyright, you may submit a DMCA takedown notice to our designated agent. Your notice must include:
- Your identity — your full legal name and contact information (email address, mailing address, and phone number)
- Identification of the copyrighted work — a description of the copyrighted work you claim has been infringed, or a link to the original work
- Identification of the infringing content — the title, artist name, or other identifying information of the content on NCplay that you believe infringes your copyright
- Statement of good faith — a statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
- Statement of accuracy — a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner
- Your signature — a physical or electronic signature of the copyright owner or authorized representative

3. How We Respond
Upon receiving a valid DMCA takedown notice, NCplay will:
- Acknowledge receipt within 2 business days
- Review the claim to verify it contains all required information
- Remove or disable access to the allegedly infringing content within 5 business days of receiving a valid notice
- Notify relevant parties if applicable
- Document the action for our internal records
If the notice is incomplete, we will contact you to request the missing information before taking action.
4. Counter-Notification
If content was removed as a result of a DMCA takedown notice and you believe the removal was a mistake or that you have authorization to use the content, you may submit a counter-notification. Your counter-notification must include:
- Your identity — your full legal name, email address, mailing address, and phone number
- Identification of the removed content — a description of the content that was removed and where it appeared on NCplay
- Statement of good faith — a statement under penalty of perjury that you have a good faith belief that the content was removed as a result of mistake or misidentification
- Consent to jurisdiction — a statement that you consent to the jurisdiction of the federal court in your district and that you will accept service of process from the party who submitted the original takedown notice
- Your signature — a physical or electronic signature

5. Counter-Notification Process
Upon receiving a valid counter-notification:
- We will forward the counter-notification to the original complainant
- The original complainant has 10 business days to file a court action seeking to restrain the alleged infringement
- If no court action is filed within 10 business days, we will restore the removed content within 14 business days of receiving the counter-notification
- If a court action is filed, the content will remain removed pending the outcome
6. Repeat Infringers
NCplay maintains a policy of terminating or restricting access for repeat infringers in appropriate circumstances. If content is repeatedly found to infringe copyrights, we reserve the right to permanently remove it from our platform.
7. Misrepresentation
Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be subject to liability for damages, including costs and attorney's fees.

8. Limitations
This policy applies to content hosted and served through the NCplay platform. NCplay is not responsible for content hosted on third-party platforms, external links, or blockchain records.
9. Changes to This Policy
We may update this DMCA & Copyright Policy from time to time. Significant changes will be communicated through in-app notifications or on our website.
